Why Ongoing Compliance Cannot Be Deferred

The most common — and most costly — mistake made by owners of offshore structures is treating ongoing compliance as optional or deferrable. In most offshore jurisdictions, a company that fails to pay its annual government fee is automatically struck off the register. Restoring a struck-off company requires a formal restoration application, payment of all outstanding fees and penalties, and — in some jurisdictions — a court order. The cost and delay of restoration invariably exceeds the cost of maintaining compliance in the first place.
